The following is a typical process for consumer bankruptcy from start to finish for both Chapter 7 and Chapter 13 Bankruptcy Cases:
1. The Initial Attorney Consultation: Our Olympia Attorney will review your last six months of income, debts, and property to determine if you qualify for Chapter 7 or Chapter 13 Bankruptcy. Our Olympia Attorney will also advise you whether filing for bankruptcy is your best financial option and if so, the timing of filing your bankruptcy petition.
2. Preparing Your Bankruptcy Petition: Our law firm pulls your credit reports, adds all creditors to your bankruptcy petition, completes all bankruptcy schedules with your real and personal property, income and expenses, last two years and last 6 months of income, any property transfers over the past two years, and all other financial information necessary to complete your bankruptcy petition.
3. Pre-Filing Credit Counseling Course: This course is required prior to filing your bankruptcy petition and can be done online from your home in about 2 hours.
4. Filing Your Bankruptcy Petition: A meeting is scheduled in our office to sign your bankruptcy petition where you will verify all financial information listed in the petition. Your bankruptcy petition is then electronically filed in U.S. Bankruptcy Court..
5. The Automatic Stay: Immediately after your bankruptcy petition is filed, an automatic stay is in place which stop all creditors from contacting you any further. From then on, creditors can only contact your bankruptcy attorney. The automatic stay also stops all foreclosure proceedings, garnishments, lawsuits, and car repossessions.
6. For Chapter 13 Cases Only, your plan payment begins: Within 30 days after your Chapter 13 petition and plan is filed, you must begin paying your monthly Chapter 13 Plan payment, even before your plan payment is confirmed.
7. The Meeting of The Creditors: Within 30-35 days of filing your bankruptcy petition, you will attend a hearing in U.S. Bankruptcy Court with your Olympia bankruptcy attorney. The hearing is called “The Meeting of The Creditors” but in reality in over 90% of your cases, none of your creditors will appear. You will be asked several basic financial questions by your assigned bankruptcy trustee and he will review your property to address how much of it is protected in your case. The hearing will probably last a few minutes and is not usually a stressful process. Your Olympia Bankruptcy Attorneys will prepare you for this hearing.
8. Confirmation Hearing: For Chapter 13 Bankruptcy Cases only, a confirmation hearing will be scheduled where your Chapter 13 payment plan is confirmed.
9. Second Creditor Counseling Course: A second credit counseling course must be completed within 45 days following your Meeting of The Creditors. This course can also be done online is takes about 2 hours to complete.
10. Debts Discharge : For Chapter 7 Bankruptcy cases, about 90-120 days after your bankruptcy petition is filed, all of your qualifying unsecured debts will be discharged (wiped out) where you will no longer have any legal obligation to pay them and your case will be closed. For Chapter 13 Bankruptcy Cases, your qualifying unsecured debts will be discharged at the end of your Chapter 13 Plan (usually either 3 or 5 years) and your case will then close.
